
According to sources from the Public Prosecutor's Office of the Principality of Asturias in Spain, prosecutors are seeking a 1-year prison sentence, a fine, and €2000 in compensation to the player for a fan who directed racial slurs at Vinicius Junior during the August 2025 match between Real Oviedo and Real Madrid at the former's home ground.
The prosecution has submitted its interim findings document to the First Instance Court of Oviedo. Prosecutors stated that the incident occurred at approximately 22:07 that evening. After Vinicius scored a goal for Real Madrid at the Carlos Tartiere Stadium, the defendant, "motivated by clear contempt for the player's skin colour", shouted racially discriminatory remarks at him and made derogatory gestures. The words and actions were clearly audible and visible at the scene, causing the player feelings of "frustration, humiliation and embarrassment".
Footage of the incident was captured by a television programme, broadcast on 25 August 2025, and simultaneously posted on its official X account, where it had garnered 309,200 views by 21:17 that night. The content was subsequently reposted by numerous digital media outlets and social media accounts, accumulating over 305 million views worldwide. Prosecutors argue that this further intensified the humiliation inflicted on the player.
Prosecutors also noted that the defendant was under the influence of alcohol at the time of the offence. They determined that his actions constitute a crime committed in the context of the exercise of constitutionally guaranteed fundamental rights and public freedoms, specifically the offence of offending the dignity of another person on racial grounds, to be punished concurrently with the offence of infringing upon personal integrity.
Should the court ultimately only convict the defendant on the charge of infringing upon personal integrity, prosecutors argue that the discriminatory circumstances should still be applied as an aggravating factor, requesting a 1-year prison sentence and ordering the defendant to pay €2000 in compensation to Vinicius Junior.
In addition, prosecutors are also seeking criminal penalties for a fan who racially abused Kylian Mbappé during the same match, underscoring Spain's hardline stance against such conduct.
